OVERVIEW

These Terms & Conditions (“Terms”) govern access to and use of https://ajaayabghar.in and purchases made through the website.

The website is operated by AJAAYABGHAR ENTERPRISES (“Ajaayabghar”, “we”, “us” or “our”), having its business address at 9/2, 1st Floor, Vaishali, Ghaziabad, Uttar Pradesh – 201012, India.

By accessing the website, creating an account, submitting information or placing an order, you agree to these Terms together with our Privacy Policy, Shipping & Delivery Policy and Returns, Refunds & Cancellations Policy.

If you do not agree with these Terms, please do not use the website or place an order.

ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a contract to place an order through this website.

A person under 18 may use the website only with the involvement and consent of a parent or lawful guardian. The adult placing the order is responsible for the transaction and information submitted.

CUSTOMER ACCOUNTS

You may be able to place an order as a guest or through a registered customer account, depending on the checkout options available.

You are responsible for:

• providing accurate, current and complete information;

• keeping your account credentials and password confidential;

• restricting unauthorised access to your account or device; and

• notifying us promptly if you suspect unauthorised account activity.

Ajaayabghar is not responsible for loss caused by a customer’s failure to protect account credentials, except where responsibility cannot lawfully be excluded.

We may suspend or restrict an account where we reasonably suspect fraud, abuse, unauthorised activity or violation of these Terms.

PRODUCT INFORMATION

We make reasonable efforts to present product descriptions, materials, dimensions, weights, colours, images, prices, care instructions and availability accurately.

However, colours may appear differently because of lighting, photography and screen settings. Product packaging may also change without materially affecting the product.

If a delivered product is materially different from the description, damaged, defective, incorrect or missing components, the customer may request an appropriate remedy under our Returns, Refunds & Cancellations Policy and applicable law.

HANDMADE AND ARTISAN-MADE PRODUCTS

Many Ajaayabghar products are handcrafted, hand-finished, made from natural materials or produced in limited quantities.

Minor variations in colour, texture, grain, brushwork, carving, engraving, finish, weight or dimensions may occur. These natural characteristics make each piece distinctive and are not considered defects when they are consistent with the product description and do not materially affect appearance or use.

A substantial departure from the published material, dimensions, functionality or agreed specification will still be reviewed as a possible defect or misdescription.

PRICING AND TAXES

Prices are displayed in Indian Rupees and ordinarily include applicable GST unless the website clearly states otherwise.

Delivery charges, special-handling charges, discounts and the final payable amount will be shown at checkout before payment.

Standard shipping is free when the merchandise value is ₹1,499 or more. A flat standard shipping charge of ₹79 applies below ₹1,499, unless another clearly displayed offer or special-handling charge applies.

We make reasonable efforts to ensure pricing accuracy. If a product is listed at an incorrect price because of a technical, typographical, tax or data-entry error, we may contact the customer for instructions or cancel the affected item and issue a full refund.

PRODUCT AVAILABILITY

Product availability is subject to stock, artisan capacity and successful quality inspection.

Adding a product to the cart does not reserve it. A product may become unavailable before payment or dispatch.

If a paid product becomes unavailable, we will offer an appropriate alternative, revised fulfilment date or full refund for the unavailable product.

ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the selected products under these Terms.

An automated order acknowledgement confirms receipt of the order but does not by itself guarantee acceptance or dispatch.

An order is accepted when we confirm dispatch or otherwise expressly confirm acceptance.

We may reasonably refuse, limit or cancel an order before dispatch because of:

• stock unavailability;

• payment failure or suspected fraud;

• incorrect pricing or product information;

• an incomplete or unserviceable address;

• unusually large quantities or suspected resale;

• delivery restrictions;

• a quality-control concern; or

• another legitimate operational or legal reason.

If we cancel a prepaid order, we will refund the amount collected for the cancelled product and any associated refundable charge.

PAYMENTS

Ajaayabghar accepts prepaid website orders.

Cash on Delivery is not available.

Payments are processed through Razorpay or another authorised payment provider displayed at checkout. Available payment methods may include cards, UPI, net banking, wallets or other methods supported by the payment provider.

Customers must not share a card PIN, UPI PIN, CVV, online-banking password or one-time password with Ajaayabghar by email, form, telephone or WhatsApp.

A payment may be declined, delayed or reversed by the payment provider, bank or card issuer. An order is confirmed for processing only after successful payment authorisation.

SHIPPING AND DELIVERY

Ajaayabghar currently delivers website orders within India only.

In-stock products are normally dispatched within one to three working days after successful payment and order confirmation. Personalised, customised or made-to-order products may require longer as stated on the product page or order communication.

Shipping, tracking, address corrections, delivery attempts, delays and undeliverable parcels are governed by our Shipping & Delivery Policy.

Delivery estimates are not guaranteed dates. Nothing in these Terms limits remedies available where goods are delivered materially later than the stated schedule for reasons not caused by force majeure.

RETURNS, REFUNDS AND EXCHANGES

Eligible standard products may be returned within seven calendar days of recorded delivery, subject to the conditions and exclusions in our Returns, Refunds & Cancellations Policy.

Personalised, customised, made-to-order, fragile, hygiene-sensitive, clearance or final-sale products may be ineligible for change-of-mind returns when clearly identified before purchase.

Non-returnable wording does not remove the customer’s right to an appropriate remedy when a product is damaged, defective, incorrect, spurious, materially misdescribed or otherwise protected under applicable law.

ORDER CANCELLATIONS

A cancellation may be requested before dispatch by emailing ajaayabghar@gmail.com with the order number.

Once dispatched, an order cannot normally be cancelled in transit. After delivery, any eligible return will be handled under our Returns, Refunds & Cancellations Policy.

Personalised, customised or made-to-order products cannot be cancelled after production, personalisation or material procurement has started.

PROMOTIONS, DISCOUNTS AND COUPONS

Promotional offers, discount codes, complimentary gifts and free-shipping offers may be subject to separate eligibility conditions, validity periods and exclusions.

Unless expressly stated otherwise:

• one coupon may be used per order;

• discounts cannot be exchanged for cash;

• promotional benefits cannot be applied retrospectively; and

• Ajaayabghar may correct, suspend or withdraw an offer affected by error, misuse or fraud.

If a return causes the retained order to fall below a promotional threshold, the applicable discount, complimentary gift or shipping benefit may be adjusted against the refund.

ARTISAN AND ARTIST APPLICATIONS

The Join Ajaayabghar form allows artists and artisans to introduce themselves and submit information for possible collaboration.

Submitting an application does not guarantee selection, purchase, representation, partnership or publication.

Applicants retain ownership of their original work and application materials. Submission does not by itself transfer copyright or grant Ajaayabghar permission to publish the applicant’s name, story, personal photograph or creative work publicly.

Any public feature, reproduction, commercial use, sale, licence or collaboration will require separate permission or agreement where applicable.

Applicants must submit only information and material they own or are authorised to share.

REVIEWS AND USER CONTENT

Where the website allows reviews, comments or other public content, you must ensure that the content:

• is based on genuine experience;

• is accurate to the best of your knowledge;

• does not infringe intellectual-property, privacy or other legal rights;

• is not defamatory, abusive, obscene, deceptive or discriminatory; and

• does not contain malware, unsolicited advertising or confidential information.

You retain ownership of original content you submit. By intentionally submitting content for public display, you grant Ajaayabghar a non-exclusive, royalty-free licence to host, reproduce and display that content for operating and promoting the website and products.

This public-content licence does not automatically apply to private artisan applications.

We may moderate or remove content that violates these Terms or applicable law. We will not knowingly publish false consumer reviews or represent ourselves as independent customers.

INTELLECTUAL PROPERTY

The Ajaayabghar name, logo, registered marks, tagline, website design, text, graphics, product presentation, photographs and other website material are owned by or licensed to Ajaayabghar unless otherwise stated.

You may access the website for personal, non-commercial shopping and information purposes.

You may not copy, reproduce, modify, distribute, republish, scrape, sell, commercially exploit or create derivative works from website content without prior written permission from the relevant rights holder.

No provision in these Terms transfers ownership of Ajaayabghar’s or an artisan’s intellectual property.

PROHIBITED USE

You must not:

• use the website for an unlawful, fraudulent or abusive purpose;

• attempt unauthorised access to accounts, servers or data;

• introduce malware, automated attacks or disruptive code;

• scrape or harvest information without permission;

• interfere with website security or operation;

• impersonate another person or submit false information;

• use stolen or unauthorised payment information; or

• infringe intellectual-property, privacy, publicity or other legal rights.

THIRD-PARTY SERVICES AND LINKS

The website uses third-party providers such as Razorpay, Shiprocket, courier companies, hosting providers and email-delivery services.

Those providers may process information and deliver services under their own terms and privacy practices.

The website may also contain links to external websites or social-media platforms. Ajaayabghar does not control external websites and is not responsible for their independent content, availability or practices.

WEBSITE AVAILABILITY

We aim to keep the website accurate, secure and available, but uninterrupted or error-free access cannot be guaranteed.

We may suspend, modify or restrict parts of the website for maintenance, security, technical, legal or operational reasons.

We may correct errors or update product details, policies, functionality or content without prior notice, subject to existing accepted orders and applicable law.

DISCLAIMER

To the extent permitted by law, the website and its general informational content are provided on an “as available” basis.

Product-specific guarantees or warranties apply only when expressly stated on the product page or supplied with the product.

Nothing in these Terms excludes statutory warranties, consumer guarantees or remedies that cannot lawfully be excluded.

LIMITATION OF LIABILITY

To the extent permitted by applicable law, Ajaayabghar will not be liable for indirect, incidental or consequential loss arising solely from website interruption, external-service failure or misuse of the website.

For a claim relating to a particular order, Ajaayabghar’s aggregate contractual liability will ordinarily not exceed the amount paid for the affected product, except where applicable law requires otherwise.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence or another liability that cannot lawfully be excluded.

INDEMNITY

To the extent permitted by law, you agree to be responsible for loss reasonably arising from your unlawful use of the website, fraudulent activity, infringement of third-party rights or material breach of these Terms.

This provision does not limit any consumer right or impose liability for matters attributable to Ajaayabghar.

FORCE MAJEURE

Ajaayabghar will not be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, severe weather, transport disruption, strikes, public restrictions, war, civil disturbance, epidemic, infrastructure failure, courier disruption or government action.

We will make reasonable efforts to communicate material delays and provide an appropriate solution.

PRIVACY

Personal data is handled according to our Privacy Policy.

By using the website, you acknowledge that information may be processed for account management, order fulfilment, payment, shipping, customer service, security, legal compliance and other purposes described in that policy.

CHANGES TO THESE TERMS

We may update these Terms to reflect changes in the website, services, policies, providers, business practices or applicable law.

The revised Terms will be posted on this page with an updated “Last updated” date.

Changes will not retrospectively reduce rights relating to an order already accepted unless required by law or agreed with the customer.

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India.

Subject to applicable consumer-protection law and the jurisdiction of competent consumer commissions, courts in Ghaziabad, Uttar Pradesh will have jurisdiction over disputes arising from these Terms or website transactions.

Before commencing formal proceedings, customers are encouraged to contact the Grievance Officer so that the matter can be reviewed and resolved promptly. This does not restrict access to any remedy available under law.

Where applicable, we will provide a complaint reference number for tracking.

We will acknowledge receipt of a consumer complaint within 48 hours and aim to resolve it within one month from the date of receipt, in accordance with applicable Indian e-commerce requirements.
